1. Who these terms are with

These Terms & Conditions govern your use of trustedbyspot.com and any Spot product or service, including the Spot Certified exam, digital certificate, registry listing, directory listing, and the Start-a-Business Toolkit ("the Services"). "Spot", "we", "us" refers to [LEGAL ENTITY NAME] trading as Spot, part of the Phantiq Studios portfolio. "You" refers to anyone using the Services.

2. What Spot is — and isn't

Spot is an independent, privately-run verification and directory standard for independent cleaners in the UK. It is not a government body, a legal licence to trade, a guarantee of work quality by any individual cleaner, or an insurer. Passing the Spot Certified exam demonstrates that you answered enough questions correctly on a specific date — it is not a warranty of your future conduct, and Spot is not liable for the acts or omissions of any Spot-Certified individual.

3. Eligibility

You must be at least 18 years old and, if purchasing on behalf of a business, authorised to do so. You must provide accurate information during onboarding, the exam, and any listing application.

4. The exam

• The exam fee (see Pricing) grants one attempt plus one free retake within 30 days if you don't pass first time.
• The pass mark and question content may be updated periodically to keep the standard current — see The Spot Standard.
• We reserve the right to suspend or revoke a registry number obtained through fraud, cheating, or provision of false information.
• Exam fees are for access to the assessment itself; a pass is not guaranteed.

5. Directory listings

• Listing is optional and separate from certification, and requires passing the exam plus a listing-readiness submission, which we review before publishing (typically within 2 business days).
• We reserve the right to decline, suspend, or remove any listing at our discretion, including for inaccurate information, complaints, or breach of the Terms of Trust.
• Directory subscriptions (Basic/Featured) renew automatically until cancelled. You can cancel anytime via the customer portal; cancellation takes effect at the end of the current billing period.
• Spot facilitates introductions between clients and listed cleaners. Spot is not a party to, and accepts no liability for, any contract, payment, or dispute between a client and a listed cleaner.

6. Payment, pricing & refunds

• All payments are processed securely via Stripe. Prices are shown inclusive of any applicable VAT unless stated otherwise.
• Because the exam is a digital service that begins immediately once you start it, once you have started an exam attempt, statutory rights to cancel a distance contract for digital content (Consumer Contracts Regulations 2013) may not apply — you are asked to confirm this before starting. Unused/unstarted exam purchases may be refunded within [X] days on request.
• Subscription (directory listing) fees already charged for the current period are non-refundable on cancellation, but no further charges will be made after cancellation.
• Nothing in this clause affects your other statutory rights under the Consumer Rights Act 2015.

7. Acceptable use

You agree not to: misuse or attempt to cheat the exam; submit false information in onboarding, the exam, or a listing application; use the Services to harass, defraud, or mislead clients or other users; or attempt to interfere with the security or operation of the Services.

8. Intellectual property

The Spot name, logo, mark, exam content, and site content are the property of [LEGAL ENTITY NAME] or its licensors. Your Spot Certified badge and certificate may be displayed by you for the purpose of promoting your own cleaning services while your certification remains valid, and must not be altered or used to misrepresent your registry status.

9. Limitation of liability

To the fullest extent permitted by law, Spot's total liability to you for any claim arising from the Services is limited to the amount you paid to Spot in the 12 months preceding the claim. We are not liable for indirect or consequential losses, or for the acts of any third-party cleaner or client. Nothing in these terms excludes liability that cannot be excluded under UK law (e.g. for death, personal injury caused by negligence, or fraud).

10. Termination

We may suspend or terminate your access to the Services for breach of these terms, the Terms of Trust, or for fraudulent or harmful conduct.

11. Governing law

These terms are governed by the laws of England and Wales. UK consumers may also be entitled to bring claims in their local courts.
